Terms of Service

These Terms of Service ("Terms") are an agreement between you and Elevate Integration Bodyworks ("we", "us", "our"), a massage therapy and Structural Integration practice operated by Beth Barney, LMT, BCSI, located at 2197 South 725 East, Clearfield, Utah 84015. They cover three things: the bodywork services we provide, our text messaging, and your use of this website. By booking a session, texting us, or using this site, you agree to these Terms. If you do not agree, please do not use the site or book a session.

1. Services and bookings

We provide massage therapy and Structural Integration services, including Structural Integration, Myokinetic Therapy, relaxation massage, prenatal massage, and sports and recovery massage. Sessions are by appointment at our Clearfield studio.

Appointments are booked through our online booking provider, or requested through the form on our Contact page or by calling or texting (801) 668-2876. A booking made through the online booking provider is subject to the session lengths, pricing, and cancellation and no-show policy shown there at the time you book, and those terms apply in addition to these Terms. A message sent through the contact form is a request, not a confirmed appointment — it is confirmed when we reply with a time. Please arrive on time; a late arrival may shorten your session so that following appointments are not delayed.

Payment is due at the time of service unless we agree otherwise in writing. We accept Blue Cross Blue Shield; coverage, eligibility, and any amount owed are determined by your plan, and you remain responsible for any balance your insurer does not pay. Verifying your own benefits before your appointment is the surest way to avoid a surprise.

2. Health information and informed consent

Bodywork is hands-on work, and doing it safely depends on what you tell us. You agree to disclose, before and during your session, any medical conditions, injuries, surgeries, allergies, medications, pregnancy, or symptoms that could affect your care. If any of that changes between visits, tell us at your next appointment.

You may ask us to adjust pressure or technique, or to stop the session entirely, at any time and for any reason. We will honor that immediately. You will be properly draped throughout your session, and only the area being worked on will be undraped. For Structural Integration and myokinetic sessions we will ask you to wear athletic clothing so the area stays visible and you can move.

We may decline or discontinue service where, in our professional judgment, treatment would be unsafe or inappropriate, or where a condition should first be evaluated by a physician.

3. Not medical advice

Massage therapy and Structural Integration are complementary services. They are not a substitute for medical diagnosis, treatment, or care from a licensed physician, and nothing we say in a session, on this website, or in a text message is medical advice or a diagnosis. No practitioner-patient medical relationship is created by using this site. Talk to your physician about medical concerns and before starting any new treatment, and never disregard or delay medical advice because of something you read here. If you are experiencing a medical emergency, call 911.

Results vary from person to person. Nothing on this website is a guarantee of any particular outcome.

4. Professional conduct

This is a professional therapeutic practice. Any sexual advance, solicitation, or inappropriate remark or contact will end the session immediately, will end our professional relationship, and may be reported to law enforcement and to the Utah Division of Professional Licensing. We also ask that you not attend a session under the influence of alcohol or non-prescribed drugs.

5. Use of this website

You may use this website for your own personal, non-commercial purposes — learning about our services, finding our studio, contacting us, and booking a session. You agree not to use the site to break the law, to interfere with or disrupt it, to attempt to gain unauthorized access to any part of it, to scrape or harvest content or contact details by automated means, or to submit false information or someone else's personal information through our forms.

Any information you submit through a form on this site should be accurate and your own. Do not send us sensitive information you would not want transmitted over the internet; no method of transmission is completely secure.

We aim to keep the site accurate and available, but we do not promise it will be uninterrupted, error-free, or current at all times. We may change, suspend, or discontinue any part of it at any time.

6. Intellectual property

The content on this website — text, photographs, graphics, the Elevate Integration Bodyworks name and logo, and the arrangement of it all — is owned by us or used with permission, and is protected by copyright and trademark law. You may not copy, reproduce, republish, or distribute it for commercial purposes without our written permission.

7. Third-party services and links

We use third-party services to run parts of this site and our practice, including our online booking provider and the form provider that powers the contact form on our Contact page. This site may also link to third-party websites. We do not control those services or sites and are not responsible for their content, availability, or privacy practices; their own terms and privacy policies govern your use of them.

8. Disclaimers and limitation of liability

To the fullest extent permitted by Utah law, this website and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the fullest extent permitted by law, Elevate Integration Bodyworks and Beth Barney will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of your use of this website. Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability for gross negligence or willful misconduct, and nothing here limits your rights under Utah law with respect to the professional services you receive.

9. Governing law

These Terms are governed by the laws of the State of Utah, without regard to its conflict of law rules. Any dispute arising out of these Terms, this website, or the services will be brought in the state or federal courts located in Davis County, Utah, and you and we consent to the jurisdiction of those courts.

10. Our Services

Elevate Integration Bodyworks provides the services described on this website. The specific work, price, and schedule for your job are set out in the quote, estimate, or written agreement we provide for that job, which together with these Terms forms the agreement between us. Descriptions and any figures shown on this website are general information, not a binding quote. Scheduling depends on availability, weather, parts and material lead times, and other factors outside our control, so any dates we give are estimates and can change. If the scope of the work changes, or conditions are found once work begins that we could not see beforehand, we will discuss any change to price or timeline with you before continuing.

11. Age Restriction

This website and our services are intended for adults. You must be 18 or older to use this website, request or purchase services from Elevate Integration Bodyworks, provide us with a mobile number, or consent to receive text messages from us. By using this website or opting in to our text messages, you confirm that you are 18 or older. If you are under 18, please do not submit any information through this website.

12. SMS / Text Messaging Terms

Elevate Integration Bodyworks operates a text messaging program so customers and prospective customers can reach us and receive service updates. These SMS terms form part of these Terms & Conditions.

• Program description and message types. Messages relate to the service you asked us about: replies to your questions, quotes and estimates, appointment confirmations and reminders, arrival and job-status updates, invoices and receipts, and follow-up about work we have completed for you. We do not send recurring marketing or promotional text campaigns.
• How you opt in. You consent to receive text messages by giving us your mobile number and asking us to contact you — for example by submitting a request form on this website, by ticking a text-message consent box where one is provided, or by texting us first at (801) 668-2876. Consent to receive text messages is not a condition of purchasing any goods or services.
• Message frequency. Message frequency varies and depends on your conversation with us and on any active or upcoming job.
• Message and data rates. Message and data rates may apply, depending on your mobile carrier and plan. Elevate Integration Bodyworks is not responsible for charges from your carrier.
• How to opt out. Text STOP to (801) 668-2876 at any time to cancel. You will receive one final message confirming that you have been unsubscribed, and we will send no further texts to that number. You can opt back in at any time by texting us again.
• How to get help. Reply HELP to any message for assistance, or contact us at (801) 668-2876 or Bbarney@Elevate-Integration.com. Full support details are at the end of these Terms.
• Carrier liability. Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on effective transmission by your mobile carrier.
• Supported carriers. Our program is supported by major mobile carriers in the United States. Carriers are not responsible for the content of messages.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

The mobile information you share with us, and your text messaging consent, are handled as described in our Privacy Policy.

13. Privacy

Our Privacy Policy explains what information Elevate Integration Bodyworks collects, how we use and protect it, how our text messaging consent works, and the choices and rights you have. It forms part of these Terms, and by using this website or our services you agree to it. Where these Terms and the Privacy Policy overlap on how we handle personal information, the Privacy Policy applies.

14. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on this page, and we will revise the "Last updated" date above. Your continued use of this website or our services after changes are posted means you accept the updated Terms.
